9. Management and other education staff

In line with the Law of Ukraine on Education (закон України ‘Про освіту’), the following bodies carry out the governance of an education institution: the founding body; the head of the institution; a collegial management body; a collegial self-governance body; and other bodies defined by special legislation and the institution’s statutes. The expansion of institutional autonomy provides heads of institutions with full managerial responsibility for all areas of institutional operation, with the possibility to appoint deputy heads responsible for key functions (educational, pedagogical, research, administrative and operational, financial and economic, etc.).

In early childhood and care, general secondary and vocational education, founders appoint heads of institutions in accordance with the Laws of Ukraine on Early Childhood Education (закон України ‘Про дошкільну освіту’),on Complete General Secondary Education (закон України ‘Про повну загальну середню освіту’), on Vocational Education (закон України ‘Про професійну освіту’) and on Professional Pre-Higher Education (закон України ‘Про фахову передвищу освіту’). Institutions employ administrative and managerial staff, teaching (and research-teaching) staff, collegial management bodies and self-governance bodies. Additional categories of pedagogical staff are also engaged, including educational psychologists, social pedagogues, teaching assistants in inclusive classrooms, childcare staff, activity coordinators, special education teachers and speech therapists. Institutions also employ auxiliary staff, including engineering and technical personnel, security staff, accountants, economists, head cooks, medical workers and others, who ensure the institution’s continuous functioning.

Higher education institutions have the highest level of autonomy. Rectors lead these institutions and are appointed in accordance with the Law of Ukraine on Higher Education (закон України ‘Про вищу освіту’). At the faculty or institute level, deans or directors perform administrative functions, while heads of department take responsibility at the departmental level. Collegial bodies take key decisions within the framework of national legislation, and administrative staff support their implementation.

The Labour Code of Ukraine (Кодекс законів про працю України) and other relevant legislative acts regulate employment relations. Remuneration is defined by special legislation and may be financed from state and local budgets, founders’ contributions, own revenues, grants and other sources not prohibited by law.

In state and municipal institutions, remuneration follows Resolution of the Cabinet of Ministers of Ukraine No 1298 of 30 August 2002 ‘On the Remuneration of Employees Based on the Unified Tariff Grid for Employees of Budgetary Institutions’ (‘Про оплату праці працівників на основі Єдиної тарифної сітки розрядів і коефіцієнтів з оплати праці працівників установ, закладів та організацій окремих галузей бюджетної сфери’) and Order of the Ministry of Education and Science of Ukraine No 557 of 26 September 2005 ‘On the Regulation of Remuneration Conditions and Approval of Tariff Grades for Employees of Education Institutions and Research Organisations’ (‘Про впорядкування умов оплати праці та затвердження схем тарифних розрядів працівників навчальних закладів, установ освіти та наукових установ’). These acts set tariff grades, allowances and supplements.

In private institutions, founders define remuneration conditions, while any use of public funds must comply with the requirements that apply to the public sector.

The development and application of professional standards, including those for education-sector employees, comply with Resolution of the Cabinet of Ministers of Ukraine No 373 of 31 May 2017 ‘On Approval of the Procedure for Developing, Implementing and Reviewing Professional Standards’ (‘Про затвердження Порядку розроблення, введення в дію та перегляду професійних стандартів’).
